The Superintendent of Schools shall have the power and authority to make assignments to the various schools in the district of all non-instructional and non-licensed employees and all licensed employees, as provided in Sections 37-9-15 and 37-9-17, and to make reassignments of such employees from time to time; however, a reassignment of a licensed employee may only be to an area in which the employee has a valid license issued by the State Department of Education. Upon request from any employee transferred, such assignment shall be subject to review by the School Board. ' 37-9-14 (s) 1999
Certified and Classified Personnel Transfer
The School Board has as its primary concern the well being of all students within the Ocean Springs School District. Therefore, should a teacher or classified staff member request a transfer to a different teaching or classified position within the system, the request will be examined as to its affect on the entire educational program. If the transfer will, in fact, improve the over-all instructional program, and/or operations of the district, the Board shall consider the request.
A member of the certified or classified staff desiring transfer within the school system shall:
- Submit a request on the Ocean Springs School District Transfer Request Form for transfer to his/her principal or immediate supervisor giving, in detail, the type of position desired and the reason for the request.
- The teacher submitting the request for transfer must meet state certification requirements for the specific subject area or grade level.
- The applicant's qualifications must be within the framework of an evaluation of experience, certification, performance and recommendations.
- If the Principal where the staff member is located recommends transfer, he/she shall sign and then forward this request to the Assistant Superintendent and to the Principal of the school where the vacancy exists.
- If the Principals(s) and the Assistant Superintendent concur in this transfer, they shall submit the recommendation to the Superintendent for his/her consideration.
- The Superintendent has the responsibility of assigning all personnel in the District with Board approval.
Professional Personnel Transfer - Involuntary
In the event that it should become necessary to transfer or reassign a certified staff member because of decrease in enrollment, insufficient funds or other causes, the following guidelines shall govern personnel actions of the administration.
A. It shall be the duty of the Superintendent to make assignments of all certificated employees as provided in Sections 37-9-15 and 37-9-17 and to make reassignments of such employees from time to time to any area in which said employee has a valid certificate issued by the State Department of Education; provided, however, that upon request from the employee so transferred, such assignment shall be subject to review by the School Board. ' 37-9-14(s)
B. Staff transfers or reassignments may be made effective during the current or the coming school year.
C. Reassignments or transfers may be made to facilitate the continued employment of a teacher who would otherwise be subject to lay-off.
D. When the administration deems it necessary or desirable to transfer/reassign certified staff members, the following criteria will serve as guidelines in staff transfers/reassignments:
1. The administration reserves the right to make transfers or reassignments that are in the best interest of the District and that are in keeping with the District's goals as related to the instructional program.
2. In determining seniority, the following items shall be considered in the order in which they are listed. (Seniority will be based on uninterrupted service in the Ocean Springs School District. Time lost during an official leave of absence does not constitute the interruption of service.)
a. Date of principal's recommendation.
b. The date of the Board's action in hiring the employee.
c. Number of years of teacher experience in the Ocean Springs School District.
d. Total number of years of teaching experience.
E. Due process shall be provided for certified employees who are affected by staff transfers/reassignments.
NO CHILD LEFT BEHIND ACT
As required by the No Child Left Behind Act of 2001, staffing patterns will be reviewed annually to ensure that poor and minority students are not taught by inexperienced, unqualified, or out-of-field teachers higher rates than are other children. If such patterns are noted, strategies to correct the problem will be developed.
